BabbleBucks Program Terms and Conditions
- Eligibility. All BabbleBucks Program participants must be a BabbleBee member with their account in good standing. Participants must have a valid credit card or checking account on file with BabbleBee.
- Opting In or Out. A BabbleBee member must opt-in to the program to become a BabbleBucks participant. Members opt-in when they initially submit their membership form, or they may go into "My Account" to change their status in the program. Members may opt-in or opt-out of the BabbleBucks program at any time during their membership; however, a member is responsible for paying any referral fees for leads that they received while opted in to the program subsequent to opting out. Likewise, a member will still be eligible to earn a referral fee for any successful leads that they sent while opted in the program subsequent to opting out. A member’s status in the BabbleBucks program when the lead was sent or received determines if a lead qualifies for a referral fee.
- Credit Balances Owed Upon Opting Out or Membership Expiration/Cancellation . If participants have a credit balance in their account upon opting out of the program, or upon their BabbleBee membership expiration or cancellation, BabbleBee will pay out their BabbleBucks balance within 30 days. BabbleBee will send the balance via a check - less any fees owed to BabbleBee or to any member for referral or service fees. If a BabbleBucks participant incurs referral fees subsequent to opting out, and no longer has a BabbleBucks balance for BabbleBee to withdraw the fees due, then BabbleBee will charge the member’s account on file in accordance with the BabbleBee Billing Policy.
- Lead Processing. All members of our Networking Community are required to submit and process all leads online using BabbleBee's online lead form. Upon the completion date of a sale or service resulting from a lead, BabbleBucks Program referral receiving members, agree to submit the accurate amount of the sale and or service gross revenue, to complete the lead form, and to pay the earned referral fee. When BabbleBee receives the completed lead form, BabbleBee will automatically withdraw the referral fee due from the referral receiving member's BabbleBucks Account. If a member does not have adequate funds in his or her BabbleBucks account, the member's credit card or checking account - whichever method was chosen for payment of BabbleBee fees and is stored on file- will be charged. By submitting the completed lead form, BabbleBucks Program participants
authorize BabbleBee to withdraw referral fees due from their BabbleBucks and/or credit card or checking account on file. BabbleBee is responsible for collecting the referral fee and dispersing any funds that are owed to BabbleBee and/or to the BabbleBucks participant who originated the lead.
- Referral Fees.
- Referrals Received By Participants. BabbleBucks participants agree to pay a referral fee of a minimum of $15.00 or 10% of the gross revenue of a sale or service - whichever amount is greater, for any lead that they receive through the BabbleBee lead system, which results in a sale or service of over $50.00 up to the amount of $999.99, or a minimum of $100.00 or 1% of the gross revenue of the sale or service - whichever amount is greater, for any lead that they receive through the BabbleBee lead system, which in a sale or service of $1,000.00 or more. Participants owe the referral fee and should submit a successfully completed, online lead form, when the sale or service for which they received the lead has been completed. A one time sale or service is considered complete, when it has been paid in full,
and a recurring service is considered complete, when an agreement has been executed for ongoing service. BabbleBee will charge the participant for the referral fee, when the participant submits the successfully completed, online lead form. Please refer to Number 4 above for lead processing guidelines and Number 6 for additional terms relating to recurring services.
- If both members are BabbleBucks participants, the referral fee that BabbleBee collects will be dispersed as follows: We will pay the referring member $9.00 or 60% (whichever amount is greater); and $6.00 or 40% (whichever amount is greater) will be paid to BabbleBee for a BabbleBee transaction fee.
- If the member that received the lead is a BabbleBucks participant, but the member that sent the lead is not a participant, then the entire referral fee that BabbleBee collects will be paid to BabbleBee and dispersed as follows: BabbleBee is paid a 20% Transaction Fee and BabbleBee is paid an 80% Non-Participant Fee.
- Referrals Sent by Participants. BabbleBucks participants are paid a referral fee of 15.00 or 10% of the gross revenue of the sale or service - whichever amount is greater, for any lead that they receive through the BabbleBee lead system, which results in a sale or service of over $50.00 up to the amount of $999.99, or a minimum of $100.00 or 1% of the gross revenue of the sale or service – whichever amount is greater, for any lead that they send through the BabbleBee lead system to a BabbleBucks participant, which in a sale or service of $1,000.00 or more, less a 4% transaction fee. BabbleBee credits a participant who sent a successful lead, when the other participant who received the lead marks the lead as successful and BabbleBee has collected the funds from the lead receiving participant.
All referral fees will be credited to the referral giving member net the transaction fee owed. All funds will be credited into a participants’ BabbleBucks account and will be stored there until they are withdrawn per Section 6. All current BabbleBucks participants have a
on their profile, and a sent lead is only eligible for a referral fee, if the BabbleBee member to whom the lead was sent is a current BabbleBucks participant. BabbleBucks participants may opt in or out of the program at any time, so participants' status is subject to change. When a BabbleBucks participant submits a lead, the referring participant will also receive a notice on the lead form upon submittal, that the lead will not be eligible for a referral fee, if the member to whom they are submitting a lead is not in the BabbleBucks program.
- Additional Terms for Referrals for Recurring Services. A member who receives a successful lead, which results in the sale of a recurring service, is responsible for paying a referral fee for up to one year of gross revenue received. A recurring service is any service that has mutual agreement between members up front to be performed on more than one occasion; otherwise, the service is considered a one time sale. When a member receives a lead for a recurring service, the receiving member must complete one lead form for the first year of projected total gross revenue, when a verbal or written contract is executed.
- Referrals Sent To BabbleBee. BabbleBee pays all members-regardless of their status in the BabbleBucks program- a 10% referral fee for leads given to BabbleBee, which result in a new member purchasing an online, standard or premium membership. BabbleBee pays the referral fee owed to a member, when the new hive member has joined and has paid the associated membership dues. For BabbleBee to pay a referral fee to a member, a joining member must state that he or she was referred by the member on his or her membership form.
- BabbleBucks Redemption. Earned BabbleBucks may be redeemed for cash, used towards referral fees, or used towards BabbleBee services. Members may log on to "My Account" to check the balance of their BabbleBucks account.
- Cash. For participants to redeem BabbleBucks for cash, participants must go to "My Account" and click on BabbleBucks (http://www.babblebee.com/myaccount/profile_bbucks.cfm) to request a pay out. BabbleBee will pay BabbleBucks funds out by sending out a check in USPS mail. Participants should receive their funds within 14 days from their payout request.
- Referral Fees Owed. Participants use the BabbleBucks that they have accrued to pay any referral fees that they owe to other members. When a participant owes referral fees to another member, BabbleBee will automatically deduct referral fees owed from the participants’ BabbleBucks account. Please refer to Number 4 and 5 above for more information on lead processing and referral fees respectively.
- BabbleBee Services. Participants may use their BabbleBucks balance toward any BabbleBee services. For a participant to use their BabbleBucks balance towards a BabbleBee service, the participant should complete the standard process for purchasing a service, and select BabbleBucks for payment in the shopping cart step.
- Taxes. It is the BabbleBucks participants’ responsibility to complete any State or Federal forms and to pay any applicable State and Federal income taxes on revenue exchanged through our BabbleBucks program, as well as on income received from our BabbleBucks program. Participants should consult with an accountant for any advice on their tax liability.
- Invoicing. BabbleBee is not responsible for generating any invoices or for collecting any payments associated with products or services sold between our members and their customers.
- Disputes. BabbleBee accepts no responsibility for any dispute that occurs between BabbleBee members and their customers.
- Participant Responsibilities. BabbleBucks Program participants agree to report all sales that occur as a result of a lead from a BabbleBee member and to complete all online lead forms as required. Participants agree to accurately report a product or service sale's gross revenue and to pay referrals fees as owed according to the terms herein. If participants do not submit online lead forms appropriately or accurately on more than two occasions, BabbleBee will remove participants from the BabbleBucks Program for a period of 90 days. BabbleBee will serve notice of the participant's discontinuation in the program via e-mail. Members will not be eligible to collect any referral fees after being removed from the program. A member may opt-in again after a waiting period of 90 days.
- Removal from the Program. BabbleBee reserves the right, at its sole discretion, to permanently remove participants from the BabbleBucks program.
- Disclaimer. If the participant who received a successful lead and owes a referral fee defaults on payment, then Babblebee cannot pay the member who sent the successful lead. BabbleBee accepts no responsibility for any referral fees that are owed to a referral sending participant, for which a receiving participant defaults on paying. BabbleBee makes no guarantee that a referral fee will be paid.
- BabbleBucks Program Changes. BabbleBucks Program policies and terms and conditions are subject to change at any time. Each participant, by opting in to the program, agrees to be bound by these Terms and Conditions, along with any changes to the Terms and Conditions subsequently made by BabbleBee, and agrees to regularly review these Terms and Conditions to ensure that they are informed of any modification and adhere to any such modifications. We may amend the Terms and Conditions at any time by posting the amended Terms and Conditions on our site. The amended Terms and Conditions shall automatically be effective 30 days after they are initially posted on our site.
